When a hotel room/conference/banquet area is ordered, confirmed or made available, then a guest admission contract takes effect. The contract for a hotel room includes accommodation and breakfast. The contract for conference/banquet area includes only the use of this conference area. The agreed payment in each case is the market price.
The subletting of conference/banquet area, exhibitions or advertising space requires written permission from Gut Ising, K. Magalow KG (hereafter known as "the Hotel").
The contract binds the contracting parties for the entire duration of the contract to fulfilment. Room reservations will be kept up to 6 pm., after that they are made freely available. Excepted here are guaranteed bookings.
Optional bookings are binding for both contracting parties. The Hotel reserves the right to freely re-assign the reserved hotel room/conference/banquet area when the optional bookings have expired.
If the deposits requested by the Hotel are not paid by the due date, the Hotel immediately is released from any contractual agreements.
The reserved hotel room is available for the guest from 3 pm. on arrival day up to 12 noon on day of departure. Departure later than 12 noon requires the agreement of the reception on the previous evening. With departure later than 12 noon the current daily room price can be charged.
Booked conference/banquet areas are available for the contracting party at the time agreed. Extension of use requires prior agreement with the Hotel.
The contracting party has no claim to particular hotel rooms or conference/banquet areas. If the agreed hotel rooms or conference/banquet area should, for whatever reason, exceptionally not be available, the Hotel will endeavour to provide an equivalent.
The hotel personnel is available to the organizer until 1 am. For service and catering beyond that time, the valid hourly rates are charged to the organizer per employee for every hour or part of an hour.
In the case of  changes in room equipment made at short notice, we charge the valid hourly rate per employee per hour or part of an hour.
In the case of alterations and cancellations shortly booked, the following charges apply:
Up to 50 days before arrival: no charge
49-30 days before arrival: 50 % of the agreed payment
29-14 days before arrival: 60 % of the agreed payment
13-0 days before arrival: 80 % of the agreed payment
For reservations of more than 30 nights/per meeting, the cancellation terms mentioned above are extended a further 30 days.
When the contractualy agreed services or length of stay are reduced, the Hotel can withdraw from the contract without replacement, as the sales guarantee is not met.
The guest reserves the right to prove, that the Hotel suffers no or lesser damage, than the agreed lump sum as a result of not taking up the services.
If a third party has made the reservation on behalf of the guest, this party shall be liable vis-à-vis the Hotel jointly and several with the guest.
The Hotel shall be entitled to revocation of the contract if the Hotel has justified reason to assume that the guest, in making use of the Hotels` service may endanger the safety, the smooth running or the reputation of the Hotel or its guests. In this case, the guest is not entitled to compensation.
Advertisements containing data of the Hotel for invitations to sales meetings or interviews, and/or the using of the name Hotel Gut Ising for advertising purposes by the contracting party, require in principle the prior written agreement of the Hotel. If a publication occurs without the agreement of the Hotel, whereby the substantial interests of the Hotel are adversely affected, the Hotel has the right of revocation; in this case payment is due as mentioned in point 11.
For set meals and buffets the organizer has to inform the Hotel about the exact number of participants three working days before the beginning of the meeting. This number is considered a guaranteed minimum number and will be charged to the organizer by the hotel in each case. If meetings including served meals should be cancelled within three working days before beginning, 75 % of the menu/buffet price of the entire agreed price/per guest will be charged.
In principle, it is not permitted to bring along food and beverages. Exceptions only in agreement with the Hotel, the usual service costs and corkage is charged.
The bringing of presentation material or other articles is not permitted without agreement of the Hotel. All decoration material has to conform to fire regulations and may not leave any damage behind.
The person who ordered conference/banquet areas is responsible for removing all packaging or information material at his own expense. If this person does not fulfill this obligation, he is responsible for refunding to the Hotel the removal costs according to the going price.
The contracting party is responsible to the Hotel for the full extent of damage caused by itself, its assistants or its guests to buildings and inventory, in so far the contracting party cannot prove a lesser damage.
If the Hotel provides technical, decorative or other services from a third parties for the organizer the Hotel acts in the name and at the cost of the organizer. The contracting party is liable for the careful and proper treatment and return of these articles and exempts the Hotel from all claims of third parties.
Guests paying individually have to pay cash immediately without deduction. All guest accounts are payable weekly. Bills sent out with prior credit agreement are payable in full within 10 working days after receipt. In the event of delay of settlement the Hotel will charge for reminders and legal costs. Additionally interest at 5 % above the basis interest rate of the European Central Bank will be charged.
The Hotel accepts the following credit cards: Mastercard, Diners, Visa. But only for amounts which are subject neither to commission nor a special price. The Hotel is authorized in individual cases to reject foreign exchange, cheques and credit cards. On disbursements and services provided by a third party a commision of 5 % will be taken on credit card payments.
If the period between signing a contract and providing the service exceeds 180 days, the Hotel reserves the right to make price alterations within reasonable bounds without prior notice.
All prices,  including service charge and value added tax are to be made in Euro. An increase in the value added tax and/or the introduction of an alcohol tax are to be borne by the customer, independent of the date of signing a contract.
Services included within the package but not used will not be refunded.
Problems with technical or other equipment supplied will, immediately as possible, be rectified. However, retention or reduction of payments cannot be accepted. Counterclaims are excluded unless these counterclaims are established as indisputable and legaly binding. 
Objects of value, money or finacial documents (cheques, cheque cards etc..) are to be kept in the safe in the hotel room. If these are not kept there, the Hotel assumes no liability.
Wake up services will be undertaken by the Hotel with greatest care. Claims for damages will be excluded, except in cases of gross negligence or wilful intent. Articles left behind are readdressed, postage unpaid, on request. The Hotel will keep them for up to 6 months. Messages, post and packages for the guests will be handled with care. The Hotel will keep them or, on request forward them, postage unpaid. Claims for damages are excluded.
Special agreements must be in writing. The validity of individual terms of the contract or the invalidity of the conditions do not affect the validity of the other terms. In place of the invalid terms, the nearest valid term applies.
Place of delivery and exclusive area of jurisdiction is Traunstein if the customer is a registered trader, a legal entity of the public law and/or a public special asset or if the customer does not have a general place of jurisdiction in the Federal Republic of Germany.
